Navigating the legalities of marriage can be complex, but formalizing your union is essential for legal protection and civil rights. In Nepal, court marriage provides a streamlined, secular, and legally binding method to register a union under the National Civil Code, 2017 (2074).

1. What is Court Marriage in Nepal?

A court marriage is a formal marriage conducted and registered through a District Court. Unlike traditional ceremonies, its validity is derived directly from the state.

According to the National Civil Code, 2017, court marriage is available to:

  • Nepali citizens residing in Nepal.
  • Non-Resident Nepalis (NRNs) living abroad.
  • Foreign nationals intending to marry in Nepal.

The Governing Law:

Marriage laws in Nepal are strictly regulated by Sections 67 to 84 of the National Civil Code, 2017. This law governs court marriages, the registration of religious ceremonies, and marriages conducted at Nepali embassies abroad.

2. Is Marriage Registration Compulsory?

Yes. Under Section 73, all marriages must be registered to be legally recognized. You can register your marriage through:

  1. The District Court (For new court marriages).
  2. The Local Ward Office (For traditional/social marriages).
  3. Nepali Embassy/Consulate (For those residing abroad).

3. Eligibility Criteria for Court Marriage

To legally marry in Nepal, both parties must satisfy the following statutory requirements:

  • Marital Status: Both parties must be currently single, legally divorced, or widowed.
  • Age Requirement: Both individuals must have attained the minimum age of 20 years.
  • Consent: Marriage must be based on free and mutual consent, without coercion.
  • Prohibited Degrees: The parties must not fall within the "prohibited degrees of relationship" (incest laws) as defined by Nepali tradition and law.

4. Required Documents Checklist

Preparation is key to a smooth court appearance. Ensure you have the following notarized documents:

5. The Step-by-Step Procedure

The journey from application to certificate typically follows this timeline:

Step 1: Document Preparation

Collect your Single Status Certificate from your respective Ward Office. This is the most crucial document proving your eligibility.

Step 2: Filing the Application

Submit a formal application at the District Court in the district where at least one party has resided for at least 15 days.

Step 3: Verification & Deed of Consent

The judge or Marriage Registration Officer will verify all documents. Both parties and two witnesses must sign a Deed of Consent in the presence of the court.

Step 4: Issuance of Certificate

Once the judge is satisfied, the Court Marriage Certificate is issued. This usually takes 1 to 2 working days for Nepali citizens.

6. Court Marriage for Foreigners in Nepal

Nepal is a popular destination for international weddings. However, foreign nationals face a longer timeline due to the 15-day mandatory residence requirement before they can apply.

Additional Requirements for Foreigners:

  • A No Objection Certificate (NOC) or Single Status Letter from your home country’s embassy in Kathmandu.
  • A notarized Nepali translation of your home country’s marriage laws to ensure the marriage is valid in your jurisdiction.

7. Legalizing Your Marriage for Use Abroad

If you plan to use your Nepali marriage certificate for visa applications or legal matters in another country, it must be:

  1. Notarized at the Department of National Personal Record (Rastriya Kitabkhana).
  2. Attested by the Ministry of Foreign Affairs (MoFA), Nepal.
  3. Translated into English (or the destination language) by an authorized translator.

8. Laws Regarding Remarriage

Under Nepali law, remarriage is permitted only if:

  • The previous marriage was dissolved by a final divorce decree.
  • The previous spouse has passed away (Death Certificate required).
  • A legal separation through partition of property has been finalized.
